Terms of Service

1. Acceptance of Terms

By accessing or using Musée ("the Platform"), operated by Patrick Butler ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

2. Description of Service

Musée is a digital art gallery and micro-patronage platform that allows artists to share their creative work and receive financial support from patrons through micro-donations. The Platform facilitates connections between artists and supporters but does not itself create, curate, or endorse any user-generated content.

3. User Accounts

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account
• Be at least 13 years of age (or the minimum age in your jurisdiction)

4. User-Generated Content

You retain ownership of all content you upload to Musée. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on the Platform. You represent and warrant that:

• You own or have the rights to share the content you upload
• Your content does not infringe on any third-party intellectual property rights
• Your content complies with our Community Guidelines

We reserve the right to remove any content that violates these Terms or our Community Guidelines, with or without notice.

5. Payments & Patronage

Musée facilitates micro-donations between patrons and artists. Key terms:

• Platform fee: Musée retains a 2% fee on all transactions. The remaining 98% goes directly to the artist.
• Wallet system: Patrons fund their wallet to send micro-donations. Wallet balances are non-refundable once used for patronage.
• Payouts: Artists can withdraw earnings via Stripe Connect. Minimum withdrawal amounts and processing times may apply.
• Valued likes: When you send a "valued like," the configured amount is deducted from your wallet and credited to the artist.
• Direct patronage: Larger one-time donations processed through Stripe with the same 2% platform fee.

All payments are processed by Stripe. By using payment features, you also agree to Stripe's Terms of Service.

6. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Upload content that infringes on intellectual property rights
• Harass, bully, or threaten other users
• Attempt to manipulate the patronage system through fraudulent means
• Use automated tools to scrape content or interact with the Platform
• Circumvent any security features or access restrictions
• Impersonate other users or entities

7. Intellectual Property

The Musée platform, including its design, code, logos, and branding, is protected by copyright and other intellectual property laws. The Musée source code is available under the MIT License. User-generated content remains the property of its respective creators.

8. Disclaimers

The Platform is provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted access, error-free operation, or the accuracy of any content. We are not responsible for user-generated content or transactions between users.

9. Limitation of Liability

To the maximum extent permitted by law, Musée and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or goodwill.

10. Account Termination

We may suspend or terminate your account at any time for violations of these Terms or our Community Guidelines. You may delete your account at any time through your account settings. Upon termination, your right to use the Platform ceases immediately. Any pending payouts will be processed according to Stripe's policies.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
